Factual Summary
Case Title: Moraes Case â€" International Petition to the ICC for Crimes against Humanity, Analogous to War Crimes, and Judicial Abuse
of Power Summary of Communication:
The Codhes Institute â€" Institute for Cooperation, Human and Social Development, a Brazilian Public Interest Civil Society Organization (OSCIP) officially recognized by the Ministry of Justice, submits this communication under Article 15 of the Rome Statute. It denounces systematic and continuous acts committed by Justice Alexandre de Moraes, member of the Brazilian Supreme Federal Court and former President of the Superior Electoral Court, which constitute:
Crimes against humanity (Art. 7) â€" political persecution, arbitrary detention of citizens and parliamentarians, large-
scale censorship, and asset freezes without due process of law;
Acts analogous to war crimes (Art. 8) â€" judicial decisions with hostile effects against foreign nations and the use of
state apparatus for mass ideological persecution;
Judicial abuse of power â€" abnormal concentration of investigative, prosecutorial, and adjudicative functions in a single

magistrate, amounting to institutional hijacking and suppression of democracy. Given the paralysis of domestic institutions in Brazil, the Institute respectfully requests the ICC Prosecutor to:
- Register and open a preliminary examination;
- Consider urgent precautionary measures;
- Ultimately hold the accused internationally accountable, with application of the maximum penalty under Article 77 of the Rome Statute (life imprisonment).
