Context The Codhes Institute submits this URGENT precautionary communication to the ICC Prosecutor, as a complement to the principal submission already on record. It refers to the imminent risk arising from the domestic hearing scheduled between 2 and 12 September 2025, under the supervision of a judicial authority already denounced before this Court for practices prima facie amounting to crimes against humanity (Art. 7) and acts analogous to war crimes (Art. 8). Legal Grounds Article 17 â€" Complementarity: Brazil’s internal system is unwilling/unable to provide effective remedies, as the authority in charge is implicated in the alleged crimes. Article 58 â€" Precautionary Measures: The suspension of the hearing is a proportionate and necessary measure to prevent irreparable harm and safeguard the Court’s jurisdiction. Article 68 â€" Protection of Victims and Witnesses: The hearing entails concrete risks of intimidation, persecution, and + retaliation.

Article 15 â€" Prosecutor’s Initiative: The Prosecutor may act proprio motu based on this formal and substantiated communication. Jurisprudence: Situation in Kenya (ICC-01/09), Darfur (ICC-02/05), Al-Senussi (ICC-01/11-01/11), Côte d’Ivoire (ICC- 02/11), Gaddafi (ICC-01/11-01/11), Lubanga (ICC-01/04-01/06), Bemba (ICC-01/05-01/08). Requests 1. Immediate receipt of this communication under Article 15. 2. Urgent suspension of the domestic hearing scheduled for 2 September 2025, or at least its interruption during its course until 12 September 2025. 3. Formal recommendation to the Brazilian State to ensure impartiality and the protection of victims/witnesses. 4. Alternatively, adoption of measures such as: restriction of publicity of the proceedings; international monitoring and reporting to the ICC; + exclusion of testimonies collected from any use in ICC proceedings. 1. Should the risks persist, the opening of a formal international investigation under Article 15(3). Closing Given the extreme urgency, the requested precautionary suspension is not merely procedural but a civilizational imperative to safeguard human dignity, the integrity of victims, the ICC’s jurisdiction, and to mitigate escalating diplomatic tensions between Brazil and the United States.
